How well established were the rules of the road (ocean) in Nelson's times?

Was it then accepted that a ship sailing large should give way to one close-hauled, and that a ship close-hauled on the larboard tack should give way to a ship close-hauled on the starboard tack?

If so, were the rules yet established by Admiralty regulation, or just by custom?
