Yes it is another example of theatricals with a pre-planned reprieve. Nelson was acting CiC after Richard Hughes had gone home. In this case, as he often did at this stage of his career, he cocked it up. He exceeded his authority by granting a full pardon - which only the King could do. He also gave Clarke a complete discharge. Clarke was a serial deserter, so what sort of example or deterrent that was supposed to create entirely defeats me! Nelson was a bit of an idiot at times!
Supposedly, Prince William Henry requested the reprieve, and Nelson couldn't think straight when he was involved.
